No criminal charges for Wharton man accused of crashing into motorcyclists while texting

A Wharton man who allegedly was on his cell phone when he collided with a motorcycle will not face criminal charges, though the cyclists both lost a leg in the crash.

The Morris County Prosecutor’s Office reviewed circumstances of the Sept. 21, 2009, crash between pick-up truck driver Kyle Best and the motorcyclists, Linda and David Kubert of Dover, and opted not to pursue criminal charges, such as assault-by-auto.
